The Colorado Judicial Branch provides an excellent online resource for Denver divorce papers and other documents you may need, depending on your unique family circumstances.

Do I Have to Go to Court for a Divorce in Denver?

  • Child support and spousal support payments
  • The division of all marital property and debts

While there is no need to go through the courts with an uncontested divorce in Denver, also called a “decree upon affidavit,“ you will have to fulfill specific requirements, including:

  • Both spouses agree that the marriage is irretrievably broken
  • Having been a resident in Colorado for more than 90 days
  • You both signed a separation agreement detailing how the property is to be divided between you, or you do not have any common marital property
  • You have no minor children, or you both signed a separation agreement dealing with child custody and financial support matters

If you are filing for the divorce on your own, you will also have to provide evidence of having served your spouse with the affidavit. A judge will typically approve the divorce with a “decree of dissolution of marriage” after 91 days unless there is any discrepancy with the paperwork or they believe one party has been unfairly treated with the separation agreement.

Denver Divorce Papers for an Uncontested Divorce

If you are filing for an uncontested divorce, you must submit an “affidavit for decree without appearance of parties” in the Denver County district court. You can file the affidavit alone or with your spouse. It is important to note that Denver divorce papers must be delivered personally to court and cannot be filed online. If you are filing on your own, you will have to serve your spouse with the affidavit. However, if you are filing together
